Declared value / limited liability

The liability of PONY EXPRESS for the courier services rendered is limited and does not exceed 50 US dollars per dispatch packed in a PONY EXPRESS envelope and 500 US dollars for other dispatches and freight forwarded under a single consignment note, unless the consignor has declared a higher value for the dispatch. If the dispatch consists of several pieces, the declared value of each piece is determined by dividing the total declared value by the number of pieces forwarded under the given consignment note. If the consignor declares a dispatch value of over 500 US dollars, indicated in the PONY EXPRESS consignment note in the field “Declared value”, an additional charge is levied in the amount of 1% (exclusive of VAT) of the declared sum. The declared value may not exceed the actual value. When forwarding abroad, it is essential that the actual value of the freight be inserted.
If the actual value of a dispatch under a single consignment note is over 10 000 US dollars and the value of the dispatch is not declared (0 is entered in the field “Declared value”), the Order Acceptance Department will consider the possibility of transporting it once the Customer has completed the Order/application form for provision of services - see Appendix 11.
If the actual value of a dispatch under a single consignment note is over 10 000 US dollars and the consignor has declared the value of the dispatch, the possibility of transporting it is considered after the Order/application form for provision of services has been drawn up - see Appendix 11.

PONY EXPRESS is not liable for the loss of items prohibited for shipping (see clause 4) and other items not declared in the consignment note or the invoice, or for their confiscation by government authorities. In order to resolve disputes associated with violations against the safekeeping of a dispatch, the parties shall, at the time of delivery and in the presence of the courier, draw up a Certificate of acceptance and delivery (Appendix 13), in which the state of the packaging is described. Claims are accepted within a period of six months of delivery or the delivery time indicated, in the form of a Letter of complaint (Appendix 8).
